Dubai Apartment Buying Process

The sequence of a typical resale purchase, from offer to registration, and where each step can stall.

This outlines a typical resale purchase of a completed apartment. Off-plan purchases from a developer follow a different sequence, and individual transactions vary.

1. Establish the facts about the property

Confirm the ownership record, the tenure, whether a mortgage is registered against the unit, whether the unit is tenanted, and the current service charge position. Dubai REST is the official service through which property and transaction information is accessed.

2. Agree terms and sign the contract

Terms are recorded in the sale contract used in Dubai for the transaction, which sets out price, deposit, timelines and responsibilities. A deposit is normally paid at this stage and held by a registered party.

3. Deal with any existing mortgage

If the seller has a mortgage, it must be settled and the charge released before the property can be transferred. This is often the step that determines the overall timeline.

4. Obtain the developer's no-objection certificate

For most resale transfers, the developer issues a no-objection certificate confirming that service charges and any other obligations are clear. Outstanding charges are typically settled at this point.

5. Transfer and registration

The transfer is completed at a registration trustee office, where fees are paid and the transaction is registered with the Dubai Land Department. The buyer's ownership is then reflected in the official record.

6. After completion

  • Transfer utility and cooling accounts into your name.
  • Register with the owners' association and set up service-charge payments.
  • If the unit is tenanted, confirm how the existing tenancy and any registered tenancy contract are handled.
  • Keep the registration documents; they are needed for any future sale or mortgage.

Frequently asked questions

How long does buying an apartment in Dubai take?
A straightforward cash resale can complete quickly once documents are in order, while transactions involving an existing mortgage or a delayed no-objection certificate take longer. Timelines are case-specific.
Do I need to be in Dubai to buy?
Not necessarily. Buyers sometimes act through a properly executed power of attorney, but the requirements are strict and should be confirmed with the authorities and a qualified adviser in advance.
